USPTO Changes How Patent Center Processes DOCX Filings, and a Missed Format Can Still Cost Up to $430

DETROIT, MI, October 07, 2026 /24-7PressRelease/ — The U.S. Patent and Trademark Office has changed how it processes patent applications filed in DOCX format, adding a review step that applicants should know about before they submit. In an August 12, 2026 announcement, the USPTO stated that Patent Center will now convert DOCX files directly to Tagged Image File Format (TIFF) during pre-submission processing instead of converting them to PDF first. Applicants may review the TIFF files before filing and download a PDF copy after submission. The agency said the change removes a redundant conversion step.

The DOCX requirement itself is not new. According to the USPTO, the specification, claims, and abstract of utility nonprovisional applications filed on or after January 17, 2024 must be submitted in DOCX format, or the applicant incurs a non-DOCX surcharge of up to $430.

What Applicants Should Know About DOCX Filing

• The requirement applies to utility nonprovisional applications filed under 35 U.S.C. 111(a), including continuation, divisional, and continuation-in-part applications.
• A specification, claims, or abstract that is not filed in DOCX format triggers the surcharge, which is up to $430.
• Drawings may be submitted in PDF format without incurring the surcharge.
• Preliminary amendments filed after the filing date are not subject to the surcharge.
• The USPTO tells applicants to review their DOCX files before submission, because the DOCX file serves as the source copy for corrections.
• Applicants who also submit an auxiliary PDF must follow the USPTO’s procedures to avoid the surcharge.
